Employment-Based Immigration Third Preference EB-3

US EB-3 is an employment-based permanent resident Immigration visa of the United States of America. The category has been designed to target overseas personnel whose services are considered essential for the domestic economy or employers are not able to locate people with appropriate skills in the local skills bank but the person being sought cannot qualify for other employment-based schemes defined under EB-1 or EB-2. The applicants intending to shift to this country through the EB-3 program need compulsorily a sponsorship from a US-based employer and need to go through the PERM process before applying for the green card.

The program has been broadly categorized into three streams, namely.

Skilled Workers

  1. Applicants must be able to substantiate that they have training or exposure of at least two years.
  2. It is essential to also substantiate here that skills the overseas workers possess are not available in the US.

Professionals

  1. The applicants must be able to substantiate that they possess requisite academic qualifications that commensurate with at least a graduation earned in either a US varsity or a foreign university (equivalent). Graduation cannot be replaced by academic qualifications and practical exposure.
  2. Parallel expertise is not available in the local skills bank of the country.

Unskilled Workers (Other Workers)

  1. During the request placement process under this category, you must be capable of undertaking tasks of unskilled personnel (that require training or education of fewer than two years). The tasks being undertaken should not be of temporary or seasonal type.
  2. Parallel workers are not available in the local skills banks of the country.   

This class of permanent visa requires labor certification and a permanent regular employment offer.
